POSESSION OF A COCAINE, METH, FENTYNALL, HEROIN, MDMA, and many others, is a 3rd degree felony in the State of Florida, and punishable by a maximum of 5 years in prison. The amount doesn’t matter, even a microgram is considered felony possession.

PRESCRIPTION MEDICATION can fall into the misdemeanor or felony category. If you are carrying pills that are not in the original bottle you will be arrested, but a defense this type of possession will require you to show a valid prescription, or proof you were holding them for someone else.

TRAFFICKING OF A CONTROLLED SUBSTANCE is a 1st degree felony punishable by a maximum of 30 years in prison. Drug Trafficking carries either a 7 year Minimum Mandatory prison sentence or a 25 year Minimum Mandatory depending on the drug in question and the weight.

SALES OF A CONTROLLED SUBSTANCE is a 2nd degree felony punishable by a maximum of 15 years in prison. In Drug Sales cases usually the cops make multiple drug sales before making an arrest, therefore increasing your score sheet point range, and increasing the minimum prison time. Most of these cases usually involve a Confidential Informant (CI), or an Undercover Police Officer (UC), or frequently both.
